Vice President Kamala Harris is emphasizing her promise to federally legalize marijuana as part of her closing argument ahead of Election Day, saying she will “create opportunities for all Americans to succeed in this new industry” if elected to the Oval Office.

Voters in several states will decide on marijuana legalization, medical cannabis and psychedelics measures on Tuesday, and Marijuana Moment will be tracking results in real time thanks to a ballot counting tool sponsored by FundCanna.

  • Florida voters are deciding on a marijuana legalization initiative that former President Donald Trump supports and Gov. Ron DeSantis (R) is vigorously campaigning against.
  • North Dakota voters have a chance to legalize marijuana through an initiative on the ballot. They rejected an earlier cannabis legalization measure two years ago.
  • South Dakota voters will decide on a marijuana legalization initiative for the third election in a row. A measure they approved in 2020 was later overturned by the state Supreme Court, and then they rejected another proposal in 2022.
  • Nebraska voters will decide on two medical cannabis legalization initiatives on the ballot amid ongoing legal challenges that could ultimately void the results of the election.
  • Massachusetts voters have a chance to make their state the third in the country to legalize certain psychedelics by approving an initiative on the ballot.
  • Oregon voters will decide on a ballot measure to require marijuana businesses to enter into labor peace agreements.
  • Voters in three Texas cities—Dallas, Bastrop and Lockhart—will decide on local marijuana decriminalization initiatives on their ballots.

A new poll of Florida likely voters shows the marijuana legalization initiative on Tuesday’s ballot falling short of support needed to pass, but within the margin of error. Meanwhile, Gov. Ron DeSantis (R) continued to ramp up his anti-cannabis rhetoric ahead of the vote.

Idaho marijuana activists are working to redraft a marijuana legalization initiative that they hope to place on the 2026 ballot following the state attorney general’s review of an initial version.

The first distribution of marijuana to members of a German social club created under the country’s legalization law has taken place, and Frankfurt is separately moving forward with a pilot program for commercial cannabis sales.

Recent polling shows that a majority of Kansas adults support legalizing recreational marijuana, but lawmakers in the Republican-controlled legislature continue to refuse enacting even a limited medical cannabis program.
